What Part of “Faithfully Execute the Laws of the United States” Don’t they Understand?

The Obama administration is going way out of their way to help illegals. (see post below).

And now, according to Hugh Hewitt, they are blatantly making up laws that are not there. They are pretending to use the Family and Medical Leave Act to force employers to give paid leave to gay people. It’s not that the law benefits gay people. That is irrelevant. The thing is that Obama is making up his own laws, without Congress.

The Labor Department is ready to tell employers they must give gay workers the same opportunity as heterosexual ones to take unpaid time off to care for their partners’ newborns or loved ones.

Two officials briefed on the policy changes said Monday that Labor Secretary Hilda Solis would announce the decision on Wednesday. The officials would only speak on the condition of anonymity ahead of the announcement.

The Family and Medical Leave Act allows workers to take up to 12 weeks of unpaid leave each year to take care of loved ones or themselves. The 1993 law also allows employees to take time for adoption but previously only applied that to heterosexual couples.

The Labor Department planned to extend those rights based on a new interpretation of the law

Here is what Hewitt says:

If this report is correct, yet another unilateral exercise in executive branch power is being substituted for Congressional action followed by a presidential signature.

This is deeply troubling, and for reasons that have nothing to do with gay rights or the lack thereof.  What a president can unilaterally bestow he can unilaterally take away.

The 1993 law that is being reinterpreted to mandate same-sex family leave benefits intended nothing of the sort.  This is a raw exercise of power by a hard-left collection of appointees who are simply in the business of doing what they want regardless of the Constitution’s requirements for law making..

Does anyone really believe –can anyone say with a straight face– that Clinton-era Labor Secretary Robert Reich wouldn’t have noticed such an intent in the law?  That gay rights groups would have been silent on the oversight for nearly two decades?

They used to call this tyranny.

The President is to faithfully execute the laws of the United States. NOT pretend they say something they say nothing about.

The President clearly has no authority to issue any such mandate.
